Terms of Service

These Terms of Service ("Terms") govern your use of the Waffle mobile app and related services (collectively, "Waffle", "the service"). By creating an account or using Waffle, you agree to these Terms. If you do not agree, do not use the service.
Waffle is operated by Yegin ("we", "us"). Contact: wafflingwafflerswaffle@gmail.com.
1. Who can use Waffle
You must be at least 13 years old to use Waffle (or 16 if you live in the European Economic Area). If you are using Waffle on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
2. Your account
You're responsible for keeping your sign-in credentials safe and for activity that happens under your account. Don't share your account. Tell us at wafflingwafflerswaffle@gmail.com if you think your account has been compromised.
3. Acceptable use
Waffle is a small space for friends. Don't use it to:
- harass, threaten, bully, or intimidate other people,
- post sexually explicit content, including content sexualising minors,
- post content that promotes self-harm, hatred, or violence against a person or group,
- post content that is illegal where you or your recipients live,
- impersonate another person or misrepresent your affiliation,
- spam other users or send unsolicited promotional content,
- scrape, crawl, or otherwise extract data from the service by automated means,
- attempt to break, probe, or circumvent the service's security,
- reverse engineer the app except to the extent applicable law permits.
We may suspend or terminate accounts that violate this section. See Section 6 for how we moderate.
4. Your content
You keep ownership of the waffles, messages, and other content you create ("Your Content").
To run the service, you grant Waffle a worldwide, non-exclusive, royalty-free licence to host, store, transmit, transcode, display, and deliver Your Content to the recipients you choose, solely for the purpose of operating Waffle. This licence ends when you delete the content, or when you delete your account — whichever comes first.
You confirm that Your Content does not infringe anyone else's rights, and that you have the right to share it with the people you send it to.
5. Our content and licence to you
The app, the brand, and our software are ours. We grant you a personal, revocable, non-transferable licence to use the app for its intended purpose under these Terms.
6. Content moderation
Waffle is a UGC service and we take moderation seriously.
- Reporting. You can report a waffle, a message, or a user from inside the app. Reports go directly to our moderation queue.
- Review time. We aim to review every report within 24 hours.
- Action. Content found in violation of these Terms will be removed. Users found to be in repeated violation may be banned without notice.
- Appeals. If you think we got it wrong, email wafflingwafflerswaffle@gmail.com and we'll take a second look.
We may also remove content or suspend accounts proactively if we discover violations, without waiting for a report.
7. Account termination
You can delete your account at any time from Settings → Profile → Delete my account. Deletion is permanent and cascade-deletes your content as described in our Privacy Policy.
We may suspend or terminate your access to Waffle at any time, with or without notice, if we believe you have violated these Terms, if we are required to by law, or if we discontinue the service.
8. Service availability
Waffle is provided "as is" and "as available". We do not guarantee that the service will always be available, uninterrupted, or error-free, and we may change or discontinue features at any time.
9. Disclaimers
To the maximum extent permitted by law, Waffle disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits any rights you have as a consumer under UK law that cannot be waived by contract.
10. Limitation of liability
To the maximum extent permitted by law, Waffle and Yegin will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of (or inability to use) the service.
Our total aggregate liability to you for any claim arising out of these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) £50.
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud).
11. Governing law and disputes
These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, except that if you are a consumer resident in another country, you may bring proceedings in the courts of your country of residence under your local consumer-protection law.
12. Changes
We may update these Terms. When we do, we'll update the "Last updated" date and, where the change is material, surface it in the app before it takes effect. Continued use of Waffle after a change means you accept the new Terms.
